Herewith I hand you extracts from minutes of meetings of the board of directors of the Tenth Ward Lumber & Building Association together with copy of correspondence passing between 10" Ward Coop Mr I, & them on the Roadway question. We shall be pleased to have you thoroughly inspect the matter and render us anopinion of our rights in the premises asper request and explanations made personally to you by Pres Musser, Vice Pres Shears and myself a short time ago. May 28/92 Prest Fuller presented the matter of a claim which the Assu. had upon the 10" Ward Coop of 4 fr. of a Roadway and appointed Directors Musser, Harris & Coulam to confer with the Directors of the Coop upon the matter. Sept. 14/92. The Special Committee that was appointed to confer with the Directors of the 10" Ward Coop in relation to a claim that the Lumber Company had for 4 feet. of a Roadway that was now built upon by the Coop reported that nothing definite had been arrived at by them. ----- new page (MSS_SC_1321_p003.jpg) Dec. 12/92. The Committee on Road- way reported through Pres. Fuller that no arraigement had as yet been made. Resolved, that a Committee of three- one by the 10" Ward Coop Just, one from the Lumber Association, and one to be selected by Wm. Grimsdell - that Prest Fuller represent the Association, and all to work for the settlement of the land claim at an early date. Dec. 27/92. In the matter of the Roadway difficulty, Prest. Fuller reported that the committee on arbitration had further consulted with Mr. Wm. Grimsdell but had not arrived at any settlement of the matter. ----- new page (MSS_SC_1321_p004.jpg) Mch. 1/93. Pres Fuller reported that the Roadway matter was in a fair way for settlement Mch. 16/93. Pres. Musser, E. Braby and St. A. Reeve. were elected to wait upon W. C. F. Grimsdell and endeavor to settle dispute with regard to Roadway. Mch. 27/93. Committee to confer with W. C. F. Grimsdell with regard to Roadway reported dispute unsettled; that our recomse was on 10" Ward Coop. as they were occupying our land; that they hoped to be able to report adjustment of difficulty shortly ----- new page (MSS_SC_1321_p005.jpg) Apl. 3/93. W. C. F. Grimsdell Jr. and John Harris, in behalf of the 10" Ward Coop, asked if we would accept less than 3 1/2 ft. of ground and balance in Cash as a compromise on the Roadway question. Voted to accept ($25000) Two hundred and fifty dollars for our Interest in the (3 1/2 ft.) three and one half feet. of disputed Roadway. Copy of Letter from 10" Wd. Coop. April 22/93. To the Pres. & Board of Directors of the 10" Wd. L. & B. Assu. Gentlemen. At a meeting of the Board of Directors of the 10" Ward Coop. M. Sust[-]. the following resolution was unanimously adopted. "Resolved, that we pay the 10" Ward. L & B. Assn. 2/3 of the original purchase price = (80000) for their share proportion ----- new page (MSS_SC_1321_p006.jpg) of the 3 1/2 ft. of roadway in dispute, amount- ing to about $12800; and W. C. F. Grimsdell 2500 if both parties will give us a quit claim deed to the same, and if these terms are not accepted, that the matter be refused to a board of arbitration consist- ing of three disinterested persons, each of the interested parties appointing one. May 1/93 After some discussion in relation to proposition submitted by 10" Ward Coop in relation to the Roadway, on motion of Director Poll it was not accepted. Director Woolley moved that the matter be settled by arbitration, the ----- new page (MSS_SC_1321_p007.jpg) Lumber Co. to appoint one disinterested person, the Coop one, and these two to select a third, we agreeing to abide by the decision rendered by them. Carried. Director Poll moved that Adam Speirs be requested to act as our. Arbitrator, and Prest. Musser was appointed to represent the Lumber Co. before the board of Arbitration. I am instructed to notify you that Mr Pettitt, our Arbitrator on the Roadway, has resigned, giving as his reason that he has not time to attend to the matter. Very Respectfully Tenth Ward Coop M. I. Director Banks moved that Secty be authorized to advise 10" Ward Coop in strong terms to appoint another arbitrator immediately so that Roadway dispute be settled without further delay. Carried. June 27/93. W.A. Rossitter & J.C. Woods representatives of the 10" Ward Coop were present and offered $16000 for our Interest in 31/2 ft. of disputed Roadway. Upon motion of Director Banks matter was tabled for one week, Pres Musser, in the meantime to wait upon the Bank and ask if they would cancel Mortgage 31/2 ft Roadway provided money for same was paid to them. I am instructed to advise you the 10" Ward L&B.A. will accept ($200 00) Two Hundred Dollars for its Interest in 3 1/2 ft. disputed Roadway provided you will pay expenses of Transfer. In reply to your communication of July 6", I have to advise you that at a meeting of the Directory of the above (10" Wd Coop) Institution , held July 19/93 the following was adopted:- Resolved, that we offer the 10" Ward Lumber & Building Assn. the sum of ($200 00) Two hundred dollars for the relinquishment of their interest in the (3 1/2 ft.) three and a one half feet of disputed roadway. Resolved that the Pres & Secty of this Assn. be and are hereby em- powered to sign a deed transferring 3 1/2 ft. Roadway belonging to this Association to the 10" Ward Cooop. M. Instn. Aug. 15/93. Musser & Director Banks were asked to wait upon Bank Officials and endeavor to induce them to release their security upon Ground in dispute. Jan. 23/94. Director Banks reported he in Connection with Pres. Musser had waited upon Bank Officials and that they promised to investigate the Roadway matter thoroughly, provided we would furnish a rough ground plan. of the property in dispute Secty was instructed to draft a plan and accompany Pres Musser & Director Banks to bank at earliest convenience ----- new page (MSS_SC_1321_p014.jpg) Feb. 1/94. Pres Musser reported that he and Director Banks & Sec. Higgs had waited upon the Bank officials and that they refused positively to cancel the mortgage on 3 1/2 ft. disputed roadway. Asked for one more week in order to confer with Attorneys and report more fully. Feb.8/94 Roadway matter deferred one week owing to sickness Pres Musser. Hillam a committee of three to meet with the Directors of the 10" Ward Coop Instn. and endeavor to make some arrangement concerning the Roadway in question, or else endeavor to have the Coop take the expense of Interest on 200 00 at 10%. Copy of a Letter sent to Coop. Aug 7/94 To the Prest. and Board of Directors of 10" Ward Cooperative Institution Gentlemen. At a recent meeting of the Board of Directors of the 10" Ward Lumber & Building Assn., a committee consisting of Adam Speirs, Edward Braby & ----- new page (MSS_SC_1321_p016.jpg) R Hillam Jr. was appointed to confer with your honorable body with a view to arriving at some definite agreement regarding the disputed roadway question. The Committee was instructed in view of the complicated condition in which the matter is at present situated to ask that your Institution bear the expense of Interest on Two hundred Dollars at 10% per year until such time as direct purchase at the agreed figure could be effected. or other agreeable arrangements made.
